Allocation of cases is CJI’s prerogative: SC- Namaste English

The SC today dismissed a petition that sought that the CJI should consult the two senior-most judges of the apex court for an allocation of cases. While dismissing the PIL, the court held in a judgment that The Chief Justice of India (CJI) is a high constitutional office entrusted with the duty to constitute Benches and allocate cases for the smooth dispensation of justice by the Supreme Court. Justice Chandrachud said that there can be no presumption of distrust against the Chief Justice of India in this prerogative that is granted by the Constitution.

अनुसूचित जाति ने आज एक याचिका खारिज कर दिया जिसमें मांग की गई थी कि केस का बंटवारा करने के लिए CJI यानि मुख्य न्यायाधीश को सर्वोच्च न्यायालय के दो वरिष्ठ न्यायाधीशों से परामर्श करना होगा। PIL को खारिज करते हुए अदालत ने अपने फैसले में कहा कि भारत के मुख्य न्यायाधीश (CJI) एक उच्च संवैधानिक कार्यालय है जिन्हे सर्वोच्च न्यायालय द्वारा न्याय के निर्वाचन के लिए न्यायपीठों के गठन करने और केस का बंटवारा करने का कर्तव्य सौंपा गया है। जस्टिस चंद्रचूड ने कहा कि संविधान द्वारा दिए गए इस विशेषाधिकार में भारत के मुख्य न्यायाधीश के खिलाफ अविश्वास का संभावना नहीं है।
