LG is bound by ‘aid and advice’ of Delhi government: SC

A five-judge Bench of the Supreme Court on Wednesday unanimously held that the when it comes to administration in Delhi, Lieutenant Governor (LG) is bound by the “aid and advice” of the popularly-elected Aam Aadmi Party (AAP) government. The court emphasized that both have to work coherently with each other and that there is no room for anarchy or absolutism in a democracy. The court added that every trivial difference of opinion between the LG and the AAP government cannot be referred to the President for a decision. 

बुधवार को सर्वोच्च न्यायालय की पांच न्यायाधीशीय खंडपीठ ने सर्वसम्मति से कहा कि जब दिल्ली में प्रशासन की बात आती है तो उपराज्यपाल लोकप्रिय रूप से निर्वाचित आम आदमी पार्टी सरकार की "सहायता और सलाह" से बाध्य हैं। अदालत ने ज़ोर देकर कहा कि दोनों को एक-दूसरे के साथ सामंजस्यपूर्ण तरीके से काम करना है और लोकतंत्र में अराजकता या तानाशाही के लिए कोई जगह नहीं है। अदालत ने यह भी कहा कि उपराज्यपाल और AAP सरकार के बीच राय के हर मामूली अंतर को निर्णय के लिए राष्ट्रपति को नहीं सौंपा जा सकता है।
