Will not dilute provisions of SC/ST Act: Supreme Court- Namaste English

The Supreme Court on Thursday once again clarified that it would not "dilute" any of the provisions of the stringent Scheduled Castes and Schedule Tribes (Prevention of Atrocities) Act, 1989. A bench of Justices Arun Mishra, Vineet Saran and S Ravindra Bhat reserved its judgement on a couple of PILs that challenged the validity of the Amendment Act 2018. Parliament had on August 9, 2018, passed the Amendment Act to overturn the apex court judgement of March 20, 2018. As the judgement caused a huge political furore, the Union government filed a review petition and pressed for restoring the stringent provisions.

सुप्रीम कोर्ट ने गुरुवार को एक बार फिर स्पष्ट किया कि वह सख़्त अनुसूचित जातियों और अनुसूचित जनजातियों (अत्याचार निवारण) अधिनियम, 1989 के प्रावधानों में से किसी को भी नहीं "घटाएगा। जस्टिस अरुण मिश्रा, विनीत सरन और एस रवींद्र भट की पीठ ने जनहित याचिका पर अपना फैसला सुरक्षित रखा, जिसमें संशोधन अधिनियम 2018 की वैधता को चुनौती दी गई थी। 9 अगस्त, 2018 को संसद ने 20 मार्च, 2018 के शीर्ष अदालत के फैसले को उलट देने के लिए संशोधन अधिनियम पारित किया था। क्योंकि फैसले के कारण भारी राजनीतिक हंगामा हुआ था, इसलिए केंद्र सरकार ने एक समीक्षा याचिका दायर की और कड़े प्रावधानों को बहाल करने के लिए दबाव डाला।
