A Constitution Bench has decided to reperuse Supreme Court's December 2013 verdict to uphold the criminalisation of homosexuality under section 377. After the court on Monday dismissed government's petition to defer the hearing, the first hearing of petitions to terminate of Section 377 was held today on Tuesday. The petitioners against Section 377 said in the court that this law, which assumes consensual gay sex as a crime, is against the fundamental rights of Indians and “societal perception” cannot be an excuse for it.

एक संविधान न्यायपीठ ने सर्वोच्च न्यायालय द्वारा दिसंबर 2013 में धारा 377 के तहत समलैंगिकता के अपराधीकरण को कायम रखने के निर्णय पर पुनर्विचार करने का फैसला किया है। सोमवार को अदालत द्वारा सरकार की सुनवाई को स्थगित करने की याचिका ख़ारिज करने के बाद, आज मंगलवार को धारा 377 को समाप्त करने के लिए याचिकाओं की पहली सुनवाई की गयी। धारा 377 के खिलाफ याचिकाकर्ताओं ने अदालत में कहा कि यह कानून, जो सहमति से किए गए समलैंगिक सेक्स को अपराध मानता है, भारतीयों के मौलिक अधिकारों के खिलाफ है और "सामाजिक धारणा" इसके होने का बहाना नहीं हो सकती है।
