A five-judge Constitution Bench of the Supreme Court on Thursday illegalized Section 377 of the Indian Penal Code (IPC) and excluded homosexuality from the purview of crime in India. While CJI Misra stated that the anguish caused by Section 377 should be remedied, justice Indu Malhotra said that society owes an apology to the LGBTQ community for the years of stigma and affliction imposed on them. After this historic decision, a wave of mirth was seen on the faces of gay adults across the country today.

सुप्रीम कोर्ट की पांच न्यायाधीशों की एक संवैधानिक पीठ ने गुरुवार को भारतीय दंड संहिता (आईपीसी) की धारा 377 को अवैध करार दिया और भारत में  समलैंगिकता को अपराध के दायरे से बाहर कर दिया। जहां मुख्य न्यायधीश मिश्रा ने कहा कि धारा 377 के कारण हुई पीड़ा का उपचार किया जाना चाहिए, जस्टिस इंदु मल्होत्रा ने कहा कि LGBTQ समुदाय पर वर्षों से लगाए गए कलंक व यातनाओं के लिए समाज को उनसे माफ़ी मांगनी चाहिए। इस ऐतिहासिक फैसले के बाद देश भर में समलैंगिक वयस्कों के चेहरे पर आज खुशी की लहर देखने को मिली।
