The Supreme Court has put off petitions hearing against the Constitution’s Article 35A to January after the Centre and the Jammu and Kashmir government argued that it could lead to a law and order situation in the state ahead of the coming panchayat and local body elections. Additional solicitor general Tushar Mehta, said that any debate on Article 35A at this juncture would have an impact on the law and order situation in the valley where elections to over 4500 posts of sarpanch scheduled. If these elections do not take place, then Rs 4,335 crore financial grant would lapse, he said.

सुप्रीम कोर्ट ने केंद्र और जम्मू-कश्मीर सरकार की इस बहस के बाद की आने वाले पंचायत और स्थानीय निकाय चुनावों से पहले राज्य में कानून और व्यवस्था की स्थिति हो सकती है, संविधान के अनुच्छेद 35 ए के खिलाफ याचिकाओं की सुनवाई जनवरी तक स्थगित कर दी हैं। जम्मू-कश्मीर सरकार के एडिशनल सॉलिसिटर जनरल तुषार मेहता ने कहा कि इस समय अनुच्छेद 35 ए पर किसी भी बहस से घाटी में कानून व्यवस्था की स्थिति पर असर पड़ेगा जहां सरपंच के 4500 से अधिक पदों पर चुनाव होंगे। यदि ये चुनाव नहीं होते हैं, तो 4,335 करोड़ रुपये का वित्तीय अनुदान ख़त्म हो जाएगा।
